APPOINTMENT OF COMMISSIONER IN
NEW YORK COUNTY, NEW YORK
THIS CAUSE came before the Court upon Plaintiffs’ Agreed Second
Amended Motion for Appointment of Commissioner and Issuance of Subpoena,
and the Court being duly advised in the premises, it is thereupon
ORDERED and ADJUDGED as follows:
1. Plaintiffs’ Agreed Second Amended Motion For Appointment of
Commissioner and Issuance of Subpoena is hereby GRANTED.
2. ABC Process Service Bureau, Inc., or its agent, is appointed
Commissioner of this Court to effect service of process of the Amended Subpoena
Duces Tecum Without Deposition (Exhibit A) on the following Records
Custodian:
“Documents” shall be defined as per the Amended Subpoena Duces Tecum without Deposition attached hereto as

documents on the date and time specified on the Amended Subpoena

4. Plaintiffs’ counsel is authorized to make inquiries at the date and time
specified on the Amended Subpoena Duces Tecum Without
Deposition and to such other further relief as this Court deems just
and proper.
5. Plaintiffs’ amended motion of April 3, 2005 is denied as moot.
